Holiday pay law encompasses holiday entitlement and holiday pay. Deceptively simple, employers often struggle with these complex regulations and may find their holiday pay schemes are unwittingly non-compliant with the law. The Working Time Regulations and the Employment Rights Act govern holiday pay law, and recent case law has revealed that many longstanding practices are, in fact, unlawful.
Starting from 1st April 2024, new measures were introduced for irregular and part-year workers, offering a novel method for calculating holiday accrual and the option for rolled-up holiday pay. These changes also include protections during sickness and statutory parental leave, ensuring fair treatment for all workers.
